The Court of Appeal has ruled in favour of Agriculture Minister Floyd Green, dismissing an appeal filed by former Jamaica Agricultural Society member Lawrence Robertson relating to alleged injunction breach.

The appeal, which was filed last year January, concerned contempt of court proceedings initiated using a defective and improperly served fixed date claim form.

A statement from the Ministry today, said Appeal Court Judge Mr. Justice Evan Brown delivered the ruling, following hearings on October 5 and 9, upholding the Supreme Court’s decision.

The Court of Appeal also awarded costs to the respondents including Mr. Green, to be agreed or taxed.

Mr. Robertson had brought the claim against the Minister and other JAS members for alleged breaches of a temporary Supreme Court injunction.

The Minister and the JAS have stated that the injunction was not in place.

The Supreme Court dismissed the claim on the grounds of procedural irregularities and deficiencies in its commencement.

In dismissing the appeal, the appellate court advised Robertson that he can re-file the contempt of court claim, using the proper fixed date form.
