Supreme Court rules in favour of 3 PNP candidates in lawsuit over removal of campaign signs

The Supreme Court has ruled in favour of three People’s National Party, PNP candidates from St. James in the lawsuit over the removal of campaign signs.

The three: Dr. Andre Haughton, Senator Janice Allen, and Allan Bernard brought the suit  against the St James Municipal Corporation.

In a statement this afternoon, the PNP said the case was triggered by the St. James Municipal Corporation’s decision, under the leadership of  Mayor of Montego Bay, the Jamaica Labour Party’s Richard Vernon, to remove multiple PNP campaign posters on April 5, 2025.

In response, the PNP candidates filed a claim for judicial review, challenging the legality and constitutionality of the corporation’s actions. 

They also applied for injunctions to prevent the corporation and its agents from removing or destroying their campaign material.

The PNP said in a decisive ruling, the court granted both the leave for judicial review and the injunctions, effectively halting the corporation’s actions and affirming the candidates’ constitutional rights.

The party said this latest courtroom success marks yet another legal win for the PNP in its ongoing defence of democracy and fairness in Jamaica, not only in the electoral arena, but across multiple instances where the law has been used to check political overreach.

Spokesperson on Justice Senator Donna Scott-Mottley, said this ruling upholds the principles of fairness, freedom of expression, and the rule of law.

She stated that the PNP will continue to challenge the abuse of state power wherever it appears, adding that no public authority has the right to suppress legitimate political participation, and no Jamaican should fear political victimisation.

The PNP has reaffirmed its commitment to stand against all forms of political intimidation, and to ensure that Jamaicans can participate in free, fair, and transparent elections.
