Opposition files law suit against Governments continued use of SOEs
The Opposition Peoples’ National Party (PNP) has filed a law suit seeking the court’s declaration on constitutional breaches, due to continuous imposition of the states of public emergency.
The PNP had indicated its intention to mount the legal challenge, last December.
Opposition Leader Mark Golding gave an update, while making his contribution to the budget debate in parliament, today.
The PNP has long argued that the manner in which the governing Jamaica Labour Party is using the SOE as a crime fighting measure, is problematic.
A previous court challenge mounted by some men who had been detained under an SOE, resulted in the court granting an order in their favour.
The governing JLP has argued that the court did not rule that the SOE is unconstitutional, only that aspects of the regulations breached citizens’ rights and these were subsequently amended.
